SCRA Lease Termination Rules
Breaking a lease without penalty
Under SCRA, active duty members can terminate residential leases early without penalty when: (1) you receive PCS orders outside reasonable commuting distance, (2) deployment orders for 90+ days, or (3) orders to move into government quarters.
Process: written notice to landlord + copy of qualifying orders. For month-to-month: effective 30 days after next rent payment due. For fixed-term: effective 30 days after next rent payment following notice.
No early termination fees, remaining payments, or penalties owed. You ARE responsible for rent through the termination date and returning the property in reasonable condition.
Vehicle leases: SCRA also allows termination of auto leases under similar conditions. Return the vehicle and provide written notice + orders. No early termination penalty — but you may owe for excess mileage or damage beyond normal wear.
